LaFarge came to RLS for assistance in determining what development rights were associated with a piece of property in Boulder County. To determine the development rights associated with the property and which of those rights were still in place, RLS conducted both a document and title review as well as extensive due diligence on the historic planning files for the property in the Boulder County planning office. RLS negotiated with Boulder County to obtain access to records that were potentially contentious to Boulder and was able to complete the necessary research for the LaFarge attorney to formulate an argument as to the value and rights associated with the property. This review included analysis of TDRs, subdivision rights, development rights prior to the enactment of Colorado subdivision regulations as well as vested property rights.
