In Grand County our client was challenged by the county regarding whether a road running through its property was a private or public right of way. This was a crucial issue to our client as they closed the road every year to facilitate its business. We were again required to research grantor/grantee indexes to see what rights were retained versus severed in transfer, old county maps to determine how the road was qualified, board of county commissioner minutes for discussion of same and surveys and plat notes for mention of same. We eventually convinced the County that the designation of the road as public was never made clear and they passed a resolution that our client could continue to close the road for its business as it had been doing historically.
